General Terms of Use – D-libre

Effective Date: 28 September 2025


1. Definitions

  • Client: A natural or legal person who places an order via the D-libre App.

  • Partner Restaurant/Store: An establishment listed in the App that prepares and sells products.

  • Delivery Person: A person who delivers the orders, employed either by Transport JYA Sàrl or by the restaurant.

  • Platform: Mobile applications and website operated by Transport JYA Sàrl under the brand “D-libre.”

  • Transport JYA Sàrl: A company based in Lausanne, Switzerland, owner and operator of the D-libre App.


2. Service Provider Identity

The D-libre App is operated by:

3. Purpose

These Terms govern the use of the D-libre App by Clients.

The App allows users to:

  1. View menus and prices of Partner Restaurants.

  2. Place orders and pay online.

  3. Arrange for home delivery or in-store pickup.


4. Contract Formation

  1. The food sales contract is concluded directly between the Client and the Restaurant.

  2. Transport JYA Sàrl acts as a technological intermediary and, in some cases, as the delivery service provider.

  3. By confirming an order, the Client agrees to pay the indicated amount.


5. Prices and Payment

  1. All prices include VAT.

  2. Delivery and/or service fees may apply, and will be visible before confirmation.

  3. Payment is processed via the D-libre App on behalf of the Restaurant.

  4. Transport JYA Sàrl is authorized by the Restaurants to collect payments on their behalf.


6. Deliveries

  1. The Client must be present at the indicated delivery address.

  2. In case of absence, the order may be left in a safe place, without further responsibility for D-libre.

  3. Items subject to age restrictions (e.g., alcohol) will only be handed over after ID verification.


7. Cancellations and Refunds

  1. Once preparation has started, the order can no longer be canceled.

  2. Perishable goods cannot be returned.

  3. Refunds are only possible in cases of non-delivery or proven error.


8. Responsibilities

  1. The Restaurant is responsible for the quality, food safety, and accuracy of menu information.

  2. The Delivery Person is responsible for the proper execution of the delivery.

  3. Transport JYA Sàrl is responsible for the proper functioning of the Platform and for processing payments.

  4. Transport JYA Sàrl cannot be held liable for delays due to traffic, force majeure, or address errors.


9. Complaints and Customer Service

Complaints may be submitted via the in-app support service or by email.


10. Personal Data

The processing of personal data is governed by D-libre’s Privacy Policy, in compliance with the Swiss Data Protection Act (LPD) and the European GDPR.


11. Modifications

D-libre reserves the right to modify these General Terms. The new versions will be published in the App and will come into effect after acceptance by the Client.


12. Applicable Law and Jurisdiction

These Terms are governed by Swiss law.

Any disputes will be submitted to the competent courts of the Canton of Vaud, Switzerland.
